A Deep Dive into the EFTA and Regulation E

The Electronic Fund Transfer Act (EFTA), implemented by Regulation E, establishes the rights, liabilities, and responsibilities of members who use electronic fund transfer services and of credit unions that offer those services. As a consumer protection statute, the EFTA (and Regulation E) impose significant compliance responsibilities on your institution. 

During this live webinar on November 10th, 2026 InfoSight360’s Director of Regulatory Compliance Counsel Michael Christians will cover the following:

  • Scope and Coverage: We’ll begin our conversation with the types of transactions that Regulation E is applicable to. We’ll also look at the transactions that are expressly exempt from coverage, such as checks.
      
  • Disclosure Requirements: Regulation E requires several disclosures, including but not limited to an initial disclosure, a change in terms notice, an error resolution notice, and periodic statements. We’ll discuss the content and timing of each of these. 
     
  • Issuance of Access Devices: During our discussion, we’ll look at the circumstances under which the credit union may issue an access device to the member. 
     
  • Member Liability for Unauthorized Transactions: A large part of the webinar will be focused on the rules regarding member liability for unauthorized transactions. We’ll cover the rules related to the loss or theft of an access device as well as unauthorized EFT’s that appear on a member’s periodic statement. We’ll also cover the Consumer Financial Protection Bureau’s FAQs specific to this area of the law. 
     
  • Error Resolution Procedures: Regulation E imposes very specific error resolution requirements and timelines on credit unions. Our conversation will address these responsibilities. 
     
  • Preauthorized Transfers (ACH Transactions): Our session will also cover the detailed authorization and stop payment requirements associated with ACH transactions. 
     
  • Requirements for Overdraft Services: For those credit unions that pay a member’s ATM/debit card transactions into the overdraft, an opt-in is required before the institution may charge a fee. We’ll look at those requirements. 
     
  • Internet Posting of Prepaid Account Agreements: Credit unions with 3,000 or more open and active prepaid accounts must submit the agreements covering those accounts to the CFPB. The webinar will address this responsibility. 
     
  • Requirements for Gift Cards: Finally, credit unions that sell gift cards have specific disclosure requirements and rules related to expiration dates and inactivity fees. We’ll cover those obligations as well.

Michael earned his Juris Doctorate from Drake University Law School. He was admitted to the Iowa State Bar in 2014 where he is licensed to practice law.
